These Terms of Service ("Terms") govern your access to and use of the social media scheduling platform at social.klustx.com, operated by KlustX Social Manager ("we", "us", or "our"). By using this service, you agree to these Terms.

By creating an account or using any feature of this platform, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them.

2. Description of Service

We provide a self-hosted social media scheduling and management tool that allows you to connect social media accounts and schedule, publish, or analyze content across supported platforms including but not limited to TikTok, Instagram, X (Twitter), LinkedIn, and Facebook.

3. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• You may not share your account with third parties without our written consent.

4. Acceptable Use

You agree not to use this platform to:

• Post, schedule, or distribute illegal, harmful, abusive, harassing, defamatory, or obscene content.
• Violate the terms of service of any connected third-party social media platform.
• Distribute spam, malware, phishing content, or unsolicited advertising.
• Attempt to gain unauthorized access to our systems or another user's account.
• Engage in any activity that could overload, damage, or impair the platform.

We reserve the right to suspend or terminate accounts that violate these rules, without prior notice.

5. Third-Party Platforms

This service connects to third-party APIs (TikTok, Meta, Google, LinkedIn, etc.). You are solely responsible for complying with each platform's terms of service, developer policies, and content guidelines. We are not liable for any suspension or ban of your social media accounts caused by your content or use of those platforms' APIs.

6. Content Ownership

You retain full ownership of the content you create and schedule through this platform. By using the service, you grant us a limited, non-exclusive license to process and transmit your content solely for the purpose of delivering the service (e.g. publishing a post on your behalf).

7. Availability and Uptime

We strive to keep the platform available but do not guarantee uninterrupted or error-free service. We may perform maintenance, updates, or experience downtime. We are not liable for any loss caused by service unavailability.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities, arising from your use of or inability to use this platform.

9. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including fitness for a particular purpose or non-infringement.

10. Termination

You may close your account at any time by contacting us. We reserve the right to terminate or suspend your access at our discretion for violations of these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of Italy. Any disputes shall be resolved in the courts of Italy.
